Terms & Conditions
Last updated 4 September 2026.
These terms govern your use of FishOut, the social listening service at fishout.ai and app.fishout.ai, operated by Covariant Labs ("we", "us"). By creating an account you agree to them.
What the service is
FishOut monitors public posts and comments across supported platforms for keywords you choose, reads what it finds for relevance and labels it, and drafts replies you can send yourself. It is provided as a hosted web service. There is no desktop or mobile application, and FishOut is not open source.
Your account
- You must give accurate account information and keep your credentials secure.
- You are responsible for what happens under your account, including anything done by members you invite and by API keys you issue.
- You must be old enough to enter a contract where you live, and you must not use FishOut if we have previously closed your account.
How you use what FishOut finds
This is the part that matters most, because the service hands you other people's public posts and a drafted reply to each one.
- FishOut never posts for you. Every draft is yours to read, edit and send from your own account. What you post is your responsibility, not ours.
- You must follow the rules of the platform you are posting on, including its policies on self-promotion, spam and disclosure. Tools that auto-post from pooled accounts get those accounts banned; FishOut deliberately does not work that way, and you should not use it as though it did.
- You must not use FishOut to harass, stalk, profile or target an individual, or to monitor a person rather than a topic, brand or market.
- Mentions may contain other people's personal data. You are the controller of that data in your workspace — see the Privacy Policy — and you must handle it lawfully, including honouring deletion requests.
Acceptable use
Do not:
- resell, sublicense or white-label the service except under a plan that expressly allows it;
- attempt to breach, overload or reverse-engineer the service, or work around plan limits or rate limits;
- use the service to break the law, infringe someone's rights, or breach a third-party platform's terms;
- scrape or re-publish the data FishOut collects in a way that the source platform's own terms prohibit.
Plans, billing and changes
- Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled. Prices are shown on the pricing page.
- You can cancel at any time. Cancellation takes effect at the end of the period you have paid for; we do not pro-rate part-months.
- If we change prices, existing subscriptions keep their price until the next renewal, and we will tell you before that renewal.
- Plan limits — keywords, platforms, alert frequency, API rate limits — are part of the plan you buy and are enforced.
Availability
We aim to keep FishOut running and to collect mentions at the cadence your plan describes, but we do not guarantee uninterrupted service. Coverage depends on third-party platforms and their APIs: a platform can change its terms, its rate limits, or its access entirely, at any time and without notice to us. If a source becomes unavailable we will say so rather than quietly stop collecting from it.
Your content and ours
You keep all rights to your account data, your keywords, your configuration and anything you write. You grant us only the licence needed to operate the service for you — to store, process and display that data, and to send it where you tell us to.
We keep all rights to FishOut itself: the software, the interface, the brand and the documentation. Nothing here transfers them to you.
Ending it
You can close your account at any time — see Data Deletion. We may suspend or close an account that breaches these terms, that puts the service or other customers at risk, or that we are legally required to stop serving. Where the circumstances allow it we will warn you first and give you a chance to export your data.
Disclaimers and liability
FishOut is provided "as is". Relevance, labels, sentiment, Reply calls and drafted replies are produced by automated systems and machine learning models; they are judgements, not facts, and they can be wrong. Do not treat them as legal, financial or professional advice, and read a mention before acting on it.
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data, or anything arising from what you chose to post. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
Changes to these terms
We may update these terms. If a change materially affects your rights we will give you notice before it takes effect, and continuing to use FishOut afterwards means you accept the new version.
